This Partner Program Privacy Policy describes how we collect, use, store, share, and protect your information when you apply to or participate in the LeadMagic Partner Program and use the Partner Portal (collectively, the "Partner Services").

This policy supplements LeadMagic's general Privacy Policy, which governs your use of all LeadMagic services. In the event of a conflict, this Partner Program Privacy Policy shall control with respect to the Partner Services.

By submitting a partner application or accessing the Partner Portal, you acknowledge that you have read, understood, and agree to the practices described in this policy.

  • Company size and primary services description

2.2 Account and Authentication Data

Information provided through your authentication provider when you sign up or log in to the Partner Portal, including your name, email address, and profile picture.

2.3 Partner Portal Activity Data

Information about how you interact with the Partner Portal, including pages visited, features used, content downloads, social posts submitted for review, and profile updates.

2.4 Commission and Performance Data

Data related to your referrals, client accounts, commission earnings, tier status, and partnership performance metrics.

2.5 Technical Data

Information collected automatically, including IP address, browser type, device information, operating system, and cookies necessary for the Partner Portal to function.

3. How We Use Your Information

We use the information we collect for the following purposes:

  • Application processing: Evaluate your partner application, verify your eligibility, and make approval decisions.
  • Account management: Manage your partner account, including tier assignments, portal access, and profile information.
  • Commissions and payments: Track referrals, calculate commissions, and process payments.
  • Communications: Send you Program-related notifications, updates, approvals, rejections, tier changes, and important notices.
  • Content and asset review: Review social media posts, profile content, and other materials you submit for approval.
  • Service improvement: Analyze usage patterns to improve the Partner Portal and Program experience.
  • Legal and compliance: Comply with legal obligations, enforce our Partner Terms of Service, and protect against fraud or abuse.

If you are located in the European Economic Area (EEA), United Kingdom, or similar jurisdictions, we process your personal information based on the following legal grounds:

We do not sell or share Partner personal information as those terms are defined under applicable privacy laws, including the CCPA/CPRA. We may disclose your information with:

  • Service providers: Third-party services that help us operate the Partner Portal, including but not limited to cloud hosting, database services, authentication, email delivery, and analytics providers.
  • LeadMagic personnel: Internal team members who manage the Partner Program, including application reviewers and partner managers.

  • Business transfers: In connection with a merger, acquisition, financing, reorganization, bankruptcy, or sale of company assets.
  • Protection of rights: When we believe disclosure is necessary to protect the rights, property, or safety of LeadMagic, our Partners, or the public.

We implement appropriate technical and organizational measures to protect your information from unauthorized access, use, alteration, disclosure, or destruction. These measures include encryption of data in transit (TLS/SSL), access controls and authentication mechanisms, regular security assessments, and secure data storage practices. We retain your personal data for as long as your partner account is active or as needed to provide Partner Services. Specific retention periods include:

  • Active partners: Data is retained for the duration of the partnership plus a reasonable wind-down period.
  • Rejected applications: Application data may be retained for up to 12 months.
  • Terminated partnerships: Certain data may be retained as required by law or for legitimate business purposes (e.g., commission records, tax compliance).

LeadMagic is based in the United States. Your information may be transferred to, stored in, and processed in the United States and other countries that may have different data protection rules than those of your country. When we transfer personal information from the EEA, UK, or Switzerland, we use appropriate safeguards such as standard contractual clauses approved by the relevant authorities.

The Partner Services are not directed to individuals under the age of 18, and we do not knowingly collect personal information from children. If we learn that we have collected personal information from a child under 18, we will take steps to delete such information promptly.
